The Site provides the Service for Registered Users which if used, must be used in addition to all other recommended safety precautions and should not be used in substitution of any other safety precautions. Please log all details of your journey with family and /or friends and leave details of your journey with your hotel etc if appropriate. All
existing recommended precautions should still be taken. Use
of the service does not guarantee that a search will be undertaken - The Service is merely a means of depositing details of your planned journey. This means that the information will be stored by TWSMRT and made available to the relevant Emergency Services should they request it. - TWSMRT can not be held responsible if the Emergency Services fail to request or fail to use the information stored by the Service. - TWSMRT will not pass on your information unless a request is made by the relevant Emergency Services. - The decision to launch a search is made by the local Emergency Services and TWSMRT can not be responsible for any failure by the Emergency Services to launch a search. - TWSMRT do not actively use the information to launch its own searches and do not actively pass on the information in all cases. - In certain circumstances the information may be unavailable to TWSMRT. This may mean that we can not access the information and will be unable to pass it on to the Emergency Services, even if they have made a request. - TWSMRT will not be responsible for any delay or failure in making the information available to the Emergency Services where such failure is caused by matters beyond its reasonable control, including but not limited to acts of God, technical malfunction of the Site and / or other technical failure, governmental actions, war or national emergency, acts of terrorism or unavailability of labour. - The "Covered Area" is currently: Northumberland,
Tyne and Wear, County Durham, Swaledale and Cleveland.
"the
Emergency Services" means the emergency services who may be expected
to undertake search and rescue duties, including but not limited to the police,
fire brigade, mountain search and rescue, paramedic and other emergency health
care services. "the Site" means www.MyTrips.org.uk "the Service" means the service provided by the Site allowing Registered Users to register details and information, including but not limited to their trips, routes, locations for overnight stops, car registration numbers. "the Terms" means these terms and conditions of use governing Registered Users and other users use of the Site. "TWSMRT" means Teesdale and Weardale Search and Mountain Rescue Team (a charity registered in England Registration number 508877) References to "we" or "us" shall be to TWSMRT or the volunteers operating and employed in the maintenance of the Site. References to "you" shall be to the Registered User, visitor or any other person permitted to use the Site. References to a law or piece of legislation is a reference to it as it is in force for the time being taking account of any amendment, extension, application or re-enactment and includes any subordinate legislation for the time being in force made under it. The Site is owned and operated by TWSMRT. The Site is provided free of charge for the benefit of all Registered Users and visitors by TWSMRT. Through your continued access and use of the Site, you are deemed to have accepted the Terms. TWSMRT grants you a non-exclusive revocable licence to access the Site. The Terms set out your rights and obligations and those of TWSMRT in relation to access to the Site and to use of the Service.
For security or other reasons, we may from time to time require you to change your password or other information ("Security Details"), which facilitates access to the Site and access may be withheld until the Security Details have been satisfactorily amended. Withdrawal of material and termination of use Access to the Site and use of the Service may be suspended or withdrawn without liability at any time by TWSMRT for legal, commercial or technical reasons. Any Registered User whose access has been suspended or terminated must not re-register for, or re-access the Site without the prior consent of TWSMRT. Each Registered User is responsible for everything which is done on or through the Site while his user account is logged on to the Site, or through his email address(es). You agree not to mis-use the Site in any illegal or criminal way; in any way which would give rise to civil liability for TWSMRT; in any way which would be technically harmful to the Site or to TWSMRT's systems; in any way which would be likely to cause offence or be of a threatening or obscene nature; or infringe the Intellectual Property Rights of a third party. TWSMRT are entitled to withdraw any material from the Site which appears to be capable of breaching any part of the Terms, any legislation or to bring the Site or TWSMRT into disrepute. You acknowledge
that TWSMRT does not monitor all material, which is submitted to or appears on
the Site and can not be held responsible for any material which is in breach of
the Terms, any legislation or causes offence in any way. The views expressed in the Site are not necessarily those of Mountain Rescue (England and Wales) or of TWSMRT. Any links to or from third party websites are not endorsements of such third party websites. TWSMRT has no control over the content of such websites and as such can accept no responsibility for them. Disclaimer Except as set out below, TWSMRT will be under no liability to you whatsoever in contract, tort (including negligence), breach of statutory duty, restitution or otherwise for any injury, damage or direct loss, indirect loss or consequential loss (all of which terms shall include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and like costs) howsoever caused arising out of or in connection with use of the Site or use of, accessing, downloading or relying on any information or other materials contained in the Site, including without limitation, as a result of any computer virus, worm, Trojan horse, logic bomb or other malicious program.
Ownership of Intellectual Property All content on the Site is owned or licensed to TWSMRT and is protected by intellectual property laws including (as applicable) copyright and trademark (including the material, which is contributed by users)TWSMRT. There is an implied consent that all material submitted to the Site will be treated as the sole property of TWSMRT and will not be subject to royalties, license or any form of control. You may view, use, download or store the material on the Site for personal use only. You may not distribute or copy any information or derivative works herein contained without the express permission of TWSMRT. Changes to this Agreement TWSMRT reserves the right to change the Terms from time to time, and post the new version on the Site. When we do so, we will notify you that there are changed terms and conditions by placing a note on the Site. The new version of the Terms will take effect, and will govern all the Site services and your relationship with the Site and TWSMRT once posted on the Site. Legal Jurisdiction The Terms shall be governed by and construed in accordance with the laws of England and Wales.
